Safeguarding Policy

Introduction

Purpose: This policy outlines Kirwans commitment to safeguarding clients, particularly those who may be vulnerable, and ensuring their protection from harm, abuse, or undue influence.

Scope: This policy applies to all employees, partners, and contractors of Kirwans.

Policy Statement

Commitment: Kirwans is committed to safeguarding the welfare of all clients and ensuring that their rights are respected and upheld.

Principles: Our safeguarding approach is based on principles of respect, confidentiality, and empowerment.

Definitions

Vulnerable Clients: Clients who may be at risk due to age, disability, mental health issues, or other factors.

Abuse and Undue Influence: Any action that harms or exploits a client, including physical, emotional, financial abuse, or coercion.

Roles and Responsibilities

Designated Safeguarding Lead: Claire Currie is responsible for overseeing safeguarding practices and responding to concerns.

All Staff: Must be vigilant and report any safeguarding concerns to the Designated Safeguarding Lead.

Procedures for Reporting Concerns

Recognising Signs: Staff should be aware of signs of abuse or undue influence, such as changes in behaviour or unexplained financial transactions.

Reporting Process: Concerns should be reported immediately to the Designated Safeguarding Lead, who will assess and take appropriate action.

Responding to Concerns

Immediate Actions: Ensure the client's safety and well-being. Document concerns and actions taken.

Confidentiality: Maintain confidentiality, sharing information only with those who need to know, unless there is a risk of harm.

Training and Support

Training Requirements: All staff undergo regular safeguarding training to recognise and respond to concerns.

Support for Staff: Provide support and guidance for staff dealing with safeguarding issues.

Legal Framework

Legislation: This policy is guided by relevant legislation, including the Solicitors Regulation Authority (SRA) guidelines and the Care Act 2014.

Approval and Implementation, Monitoring and Review

Approval: This policy is approved by Claire Currie.

Implementation: The policy forms part of the Office Manual which is read by all staff and integrated into the firm's practices.

Policy Review: This policy will be reviewed annually to ensure it remains effective and up-to-date.

Feedback Mechanism: Staff and clients can provide feedback on the policy to the Designated Safeguarding Lead.
