Probate & Estate Administration

Probate & Estate Administration

Following the loss of a loved one you may be faced with legal administrative processes that can cause additional distress at an emotional time for you and your family. Often you are left with the uncertainty as to what to do next.

At Kirwans, our experts provide you with the guidance you need, whether you require advice in dealing with the estate of a loved one, or you need a trusted advisor to carry out these services on your behalf, we are on hand to help you through what is a difficult time.

Before you can legally administer an Estate it is often necessary to obtain a ‘Grant of Representation’, the most common types of which are ‘Grant of Probate’ and ‘Grant of Letters of Administration’. Executors named in the Will, or the next of kin following the Rules of Intestacy in the absence of a Will, have the right to apply for a Grant of Probate.  This provides the legal authority allowing individuals to administer the estate of the deceased in order to distribute it correctly to the beneficiaries.

The role of Executor of an Estate is not a responsibility to be taken lightly.  Executors must act with caution as they can be held personally liable for any loss which is suffered as a result of poor administration. With Kirwans you have access to specialist legal advice that will provide you with peace of mind and confidence in the administration of an Estate.

Our approach is simple; we invest time to understand your situation. Our team of Probate experts provide clear, practical advice and will consider all the various options available to you. This includes advice regarding Inheritance Tax in administering an Estate, with advanced planning or by making use of the exemptions available to your beneficiaries with a Deed of Variation.

Whatever the complexity, Kirwans can guide and support you on your legal journey.
